Privacy Policy

1. Introduction

This Privacy Policy describes how Indy Dental Tech, LLC ("we," "us," or "our") handles information when you use the Indy Smile mobile application ("the App"). By using Indy Smile, you agree to the practices described in this policy.

Indy Smile is built to help you track your oral hygiene habits. We take your privacy seriously and have designed the App with privacy-first principles. Most information stays on your device.

2. Information We Collect

We collect only the minimum information necessary to provide the App's features.

a. Information you provide when you sign in

When you sign in with Apple, Apple may share with us:

• A unique, anonymous user identifier (does not personally identify you to us)
• Optionally, your name (only if you choose to share it)
• Optionally, your email address or an Apple-generated relay email (only if you choose to share it)

You control what Apple shares with us when you sign in.

b. Information you provide within the App

• Onboarding quiz answers: your primary oral health goal, habits you find challenging, situations you're tracking (such as orthodontic treatment), preferred notification tone, and preferred reminder times. Used only to personalize your in-app experience.
• Habit tracking data: which habits you check off each day, when, and the points earned.
• Smile Gallery photos: photos you choose to capture using the in-app camera. These photos may show your mouth, teeth, or face.
• Project information: names you give to Smile Gallery projects, notes you add, dates.

c. Information we collect automatically

• Subscription status: through Apple's StoreKit, we receive your subscription status (active, in free trial, expired, etc.). We do not receive your payment details.
• App usage data: habit completion timestamps, streak counts, lifetime point totals, badge progression, and other data the App needs to function. This data stays on your device.

d. Information we do NOT collect

• We do not collect your precise location.
• We do not collect your contacts.
• We do not access your Photos library (Smile Gallery uses only the in-app camera).
• We do not track you across other apps or websites.
• We do not use third-party analytics SDKs or advertising networks.
• We do not collect biometric data.
• We do not collect device identifiers for advertising purposes.

3. Where Your Information Is Stored

Most of your data stays on your device. Indy Smile does not currently operate a backend server. The App stores information in these locations:

• On your iPhone: habit tracking data, Smile Gallery photos, quiz answers, and app preferences are stored in the App's local storage on your device.
• In your iCloud account (if iCloud is enabled): Apple may include the App's local data in your iCloud backup. We do not have access to your iCloud backups.
• On Apple's servers: Apple maintains your Sign in with Apple identifier and your StoreKit subscription information. These are governed by Apple's Privacy Policy.

If you delete the App, the data stored on your device is removed. iCloud backups may persist according to your iCloud settings.

4. How We Use Your Information

We use the information we collect to:

• Provide and operate the App's core features (habit tracking, Smile Gallery, points, badges)
• Personalize notifications, coaching messages, and content based on your quiz answers and preferences
• Display your progress, streaks, badges, and analytics
• Process subscription purchases through Apple's StoreKit
• Send local notifications for habit reminders (these are scheduled by the App on your device, not by us)
• Detect and prevent fraudulent activity

We do not sell your information. We do not share your information with advertisers. We do not use your information for advertising.

5. Smile Gallery Photos — Important Notice

• Photos stay on your device. They are stored in your iPhone's local file system. They are not uploaded to any server we control.
• We do not view, analyze, or process your photos. Indy Smile has no backend service that receives or processes your images.
• iCloud backup may include your photos. If you have iCloud Backup enabled for Indy Smile, Apple may include your Smile Gallery photos in your encrypted iCloud backup. We do not have access to these backups.
• You can delete photos at any time through the App's Smile Gallery interface.
• You can delete all photos by deleting a project or deleting the App itself.

6. Sharing of Information

We do not sell, rent, or trade your personal information. We may share information only in these limited circumstances:

• With Apple: through Sign in with Apple (for authentication) and StoreKit (for subscriptions). These are governed by Apple's Privacy Policy.
• For legal compliance: if required by law, court order, or government regulation, we may disclose information we have. Since most of your data is not in our possession, we would generally have nothing to disclose.
• In a business transfer: if Indy Dental Tech, LLC is acquired or merged, your information may transfer as part of that transaction. We would notify you in advance.

7. Health Data Disclaimer

Indy Smile is a habit-tracking app intended for general oral hygiene support. It is not a substitute for professional dental care.

• The App is not classified as a medical device.
• The educational information shared within the App is general in nature and not personalized clinical advice.
• Although the App was created by a Registered Dental Hygienist, your use of the App does not create a clinician-patient relationship.
• For specific questions about your oral health, always consult your dentist or dental hygienist.
• The Smile Gallery is for your personal tracking only. It is not a diagnostic tool and should not be used in place of dental examinations.
• Indy Dental Tech, LLC is not a covered entity under HIPAA, and your use of the App is not subject to HIPAA protections.

8. Children's Privacy

Indy Smile is intended for users 13 years of age or older. We do not knowingly collect information from children under 13.

If you are a parent or guardian and believe your child under 13 has used the App, please contact us at hello@indydentaltech.com and we will assist in deleting any associated information from our systems.

Sign in with Apple has its own age requirements, which Apple manages.

9. Your Rights

Depending on where you live, you may have certain rights regarding your information. You can exercise these rights as follows:

• Access: you can see all your data within the App itself (habits, points, badges, photos, settings).
• Correction: you can edit your information through the App's Settings.
• Deletion: you can delete individual data (photos, projects) within the App. You can delete all data by deleting the App, or by using the "Delete Account" option in Settings.
• Data portability: currently, the App does not offer data export. You may request a copy of any information we hold about you by contacting hello@indydentaltech.com. Since most data stays on your device, our holdings are limited.
• Opt-out: you can opt out of notifications in Settings or in your iPhone's Settings app.
• California residents (CCPA): you may have additional rights under the California Consumer Privacy Act. Contact us to exercise these rights.

10. Data Retention

• Data on your device: persists until you delete it or the App.
• Subscription data with Apple: retained according to Apple's policies.
• Information you send us via email: retained for the duration necessary to respond to your inquiry, then deleted within a reasonable timeframe.

11. Data Security

We use commercially reasonable measures to protect your information:

• Sign in with Apple provides strong, privacy-preserving authentication.
• Data stored on your device is protected by iOS's built-in security features and your device passcode.
• We do not transmit your data over networks (other than to Apple for authentication and subscription).
• No security measure is 100% effective. You should also take steps to protect your device (passcode, Face ID, OS updates).

12. International Users

Indy Smile is operated from the United States. If you use the App from outside the United States, you understand that your information will be processed in accordance with United States law, which may differ from your country's laws.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by:

• Updating the "Last updated" date at the top of this policy
• Displaying a notification within the App
• For significant changes, asking you to acknowledge the new policy before continuing to use the App

Your continued use of the App after changes constitutes acceptance of the updated policy.

14. Third-Party Services

The App may include links to or integration with third-party services. Currently:

• Apple services: Sign in with Apple, StoreKit, App Store, iCloud (if enabled by you). Governed by Apple's privacy policies.
• Amazon affiliate links (future): if we add Amazon Associates affiliate links to product recommendations, tapping a link will open Amazon in your browser. Amazon's own privacy policy governs your activity there. We do not share any information about you with Amazon — they may set their own cookies for affiliate tracking.

We are not responsible for the privacy practices of third-party services.
