Terms of Service

Please read these Terms of Service carefully. By downloading, installing, or using Indy Smile, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and Indy Dental Tech, LLC ("Indy Dental Tech," "we," "us," or "our") governing your use of the Indy Smile mobile application, related websites, and services (collectively, "the App"). By using the App, you agree to these Terms and to our Privacy Policy.

2. Description of Service

Indy Smile is a mobile application that helps you track daily oral hygiene habits, capture progress photos of your smile, view analytics, receive reminders, and earn achievement badges. Indy Smile is a habit-tracking app intended for general oral hygiene support. It is not a medical device, is not a substitute for professional dental care, and does not create a clinician-patient relationship.

3. Eligibility

You must be at least 13 years old to use Indy Smile. If you are under the age of majority in your state or country, you may use the App only with the consent and supervision of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements.

4. Account Registration

To use Indy Smile, you must sign in with Apple. By signing in, you authorize us to receive from Apple a unique user identifier, and (only if you choose to share them) your name and email address. You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account. Notify us at hello@indydentaltech.com if you become aware of any unauthorized use.

5. Subscription and Billing

Indy Smile is a subscription-based application. A paid subscription is required to use the App after your free trial ends. Subscriptions are available in the following options:

Monthly: $4.99 per month, billed monthly
Annual: $39.99 per year, billed annually (saves approximately 33% versus monthly)

7-day free trial: new subscribers receive a 7-day free trial. You will not be charged during the trial. If you do not cancel at least 24 hours before the trial ends, your paid subscription will begin automatically at the price shown above.

All prices are in U.S. dollars and are subject to change. Apple processes all payments and charges your Apple ID payment method. We do not receive or store your payment information.

6. Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same subscription price you agreed to at signup, unless we notify you of a price change in advance in accordance with Apple's requirements.

7. Free Trial

The 7-day free trial is available to new subscribers only. If you cancel during the trial, you will not be charged. If you do not cancel before the trial ends, you will be charged and the subscription will begin. You may use free trials only once per Apple ID, per subscription group, unless Apple's rules permit otherwise.

8. Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID Subscription Settings:

Open the Settings app on your iPhone or iPad
Tap your name at the top
Tap Subscriptions
Select Indy Smile
Tap Cancel Subscription

Cancellations take effect at the end of the current billing period. You will retain access to Indy Smile until that period ends. Refunds, when applicable, are handled by Apple according to Apple's refund policy. Contact Apple Support to request a refund; we do not process refunds directly.

9. Rewards, Points, and Badges

As you complete habits within the App, you earn points that accumulate toward achievement badges. The App currently offers a 22-level badge progression from Bronze to Diamond.

Points and badges have no cash value. They are non-transferable, non-refundable, and cannot be redeemed for currency. Points earned during your subscription may become redeemable for products, gift cards, or promotional codes if and when we launch a Rewards Store in a future version of the App. We do not guarantee the launch, timing, availability, or specific contents of any Rewards Store or reward.

We reserve the right to modify point values, badge thresholds, redemption rules, and available rewards at any time, with or without notice. We reserve the right to invalidate points or revoke badges obtained through fraud, abuse, exploitation of bugs, or violation of these Terms.

10. User Content — Smile Gallery Photos

Indy Smile allows you to capture photos of yourself using the in-app camera. These photos are stored locally on your device and are not uploaded to any server we operate. You retain all rights, title, and interest in and to your photos.

You are solely responsible for any photos you capture and for how they are stored, shared, or backed up (including through iCloud). We are not responsible for the loss, corruption, or unauthorized access of photos on your device or in your iCloud backup.

11. Prohibited Uses

You agree not to:

Use the App for any unlawful purpose
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
Modify, adapt, translate, or create derivative works of the App
Remove any copyright, trademark, or other proprietary notices
Use the App in any manner that could damage, disable, overburden, or impair our services
Attempt to gain unauthorized access to any portion of the App or its related systems
Exploit bugs or manipulate the App to obtain points, badges, or other benefits you did not legitimately earn
Use automated means (bots, scripts, scrapers) to interact with the App
Create multiple accounts to gain unfair advantages in the rewards system

12. Intellectual Property

The App, including its design, code, text, graphics, images, logos, and all other content (excluding your user content), is the property of Indy Dental Tech, LLC and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

"Indy Smile" and "Indy Dental Tech" are trademarks of Indy Dental Tech, LLC. All other trademarks are the property of their respective owners.

13. Health Disclaimer

Indy Smile is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The information provided within the App is for general educational and habit-tracking purposes only.

Although Indy Smile was created by a Registered Dental Hygienist (RDH), use of the App does not create a clinician-patient relationship. The Smile Gallery is a personal tracking tool, not a diagnostic aid. Always consult a licensed dentist or dental hygienist for specific advice about your oral health. Do not rely on the App in place of professional dental examinations or treatment.

14. Third-Party Services and Links

The App may contain links to third-party websites, services, or products (including future Amazon Associates affiliate links). We are not responsible for the content, accuracy, privacy practices, or availability of any third-party services. Your use of any third-party service is at your own risk and subject to that third party's terms.

Where affiliate links are present, we may earn a commission if you make a qualifying purchase. This does not affect the price you pay. We disclose affiliate relationships in accordance with applicable law.

15. Disclaimers of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any content, information, or advice provided within the App is accurate, complete, or current.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDY DENTAL TECH, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or relating to your use of, or inability to use, the App. This includes but is not limited to damages for loss of profits, data, use, goodwill, or other intangible losses, whether based on warranty, contract, tort (including negligence), or any other legal theory.

Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is greater.

17. Indemnification

You agree to indemnify, defend, and hold harmless Indy Dental Tech, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the App, (b) your violation of these Terms, (c) your violation of any rights of another person or entity, or (d) any content you submit through the App.

18. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if you violate these Terms or engage in fraudulent, abusive, or illegal activity. Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination (including but not limited to intellectual property, disclaimers, limitation of liability, indemnification, and governing law) shall survive.

You may terminate your use of the App at any time by cancelling your subscription and deleting the App from your device. If you wish to delete your account entirely, use the "Delete Account" option in the App's Settings or contact us at hello@indydentaltech.com.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top and, for material changes, provide notice within the App. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

20. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, USA, without regard to its conflict of laws principles. You agree that any legal action arising out of or relating to these Terms or your use of the App shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts.

21. Dispute Resolution

Before filing a formal claim, you agree to first contact us at hello@indydentaltech.com to attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, either party may pursue formal legal action in accordance with Section 20.
